Bay Area Dancewear Returns, Exchanges & Store Policies
Refund Policy
Bay Area Dancewear strives to provide high-quality dancewear, dance footwear, and related products.
Due to the nature of dancewear, dance shoes, pointe shoes, and hygiene-sensitive merchandise, Bay Area Dancewear does not offer refunds on completed sales, except as otherwise required by applicable federal, state, or local law.
All eligible merchandise is sold under this posted policy, and customers are responsible for reviewing the policy before purchase.
Online orders canceled within twenty-four (24) hours of purchase and prior to processing, fulfillment, shipment, or special-order placement may be eligible for cancellation and a full refund at Bay Area Dancewear's sole discretion.
Exchange Policy
Bay Area Dancewear may offer exchanges for eligible merchandise within:
- Fourteen (14) calendar days of delivery for online purchases; or
- Fourteen (14) calendar days from the date of purchase for in-store purchases.
Submission of an exchange request does not guarantee approval.
All merchandise is subject to inspection and approval by Bay Area Dancewear before any exchange, store credit, replacement, or other remedy will be authorized.
Merchandise must meet all of the following requirements:
- Be in new, unworn, and resalable condition.
- Have been tried on only for fit.
- Be free from odors, pet hair, makeup, deodorant marks, stains, dirt, scuffs, or signs of wear.
- Be unwashed, unaltered, and unmodified.
- Include all original packaging, tags, labels, inserts, and accessories.
- Be accompanied by a valid receipt, order confirmation, or other proof of purchase.
Bay Area Dancewear reserves the right to deny any exchange request that does not fully comply with these requirements.
How to Request an Exchange
To initiate an exchange, customers must contact Bay Area Dancewear within the applicable exchange period and provide:
- Order number or proof of purchase;
- Customer contact information;
- Item(s) requested for exchange; and
- Reason for the exchange request.
Exchange requests may be submitted in person, by email, or through any method designated by Bay Area Dancewear.
Merchandise must not be shipped back or returned until exchange instructions have been provided by Bay Area Dancewear.
Restocking Fee
A fifteen percent (15%) restocking fee applies to all approved exchanges.
The restocking fee will be deducted from the value of the approved exchange and is intended to offset costs associated with:
- Inspection;
- Processing;
- Inventory management;
- Repackaging;
- Administrative handling; and
- Merchant transaction expenses.
The restocking fee will be waived only when Bay Area Dancewear determines, in its sole discretion, that an item was:
- Defective upon receipt;
- Damaged during shipment; or
- Incorrectly fulfilled by Bay Area Dancewear.
Exchange Shipping Costs
Unless otherwise required by law, customers are responsible for:
- Shipping charges associated with exchange requests;
- Return shipping costs;
- Shipping insurance, if desired; and
- Any costs associated with reshipping replacement merchandise.
If Bay Area Dancewear determines that merchandise was defective, damaged upon delivery, or incorrectly fulfilled, Bay Area Dancewear may, at its sole discretion, cover reasonable shipping costs associated with the approved remedy.
Fitting Services
A twenty-dollar ($20.00) fitting fee may apply to specialty footwear, pointe shoes, pointe accessories, and select dancewear fittings that require individualized professional fitting services.
The fitting fee is waived when the customer purchases the item fitted during the same appointment.
Fitting fees compensate Bay Area Dancewear for professional fitting services and are non-refundable once services have been provided.
Special Orders
Items custom-ordered, pre-ordered, special-ordered, personalized, personalized by manufacturer, or otherwise obtained specifically at a customer's request are considered Special Orders.
Special Orders:
- May require a fitting fee and/or deposit.
- Are not eligible for refunds.
- Are final sale.
- Cannot be canceled after being submitted to a manufacturer, distributor, or supplier.
- Are not eligible for exchange except when Bay Area Dancewear determines the merchandise was defective upon receipt or incorrectly fulfilled.
Bay Area Dancewear is not responsible for manufacturing delays, supplier delays, shipping delays, backorders, production interruptions, discontinued products, tariff-related delays, or other circumstances outside of its reasonable control.
Final Sale and Non-Exchangeable Merchandise
The following items are final sale and are not eligible for refunds, returns, exchanges, or store credit except where required by law:
- Tights;
- Undergarments;
- Body liners;
- Toe pads and intimate footwear accessories;
- Custom orders;
- Personalized merchandise;
- Special Orders;
- Clearance merchandise;
- Markdown merchandise;
- Gift cards;
- Digital products;
- Opened health- or hygiene-related products;
- Merchandise marked "Final Sale," "Non-Returnable," or similar language.
Bay Area Dancewear reserves the right to designate additional items as final sale at the time of purchase.
Exchange Approval and Inspection
Bay Area Dancewear reserves the sole and exclusive right to determine whether merchandise satisfies exchange eligibility requirements.
Merchandise that shows signs of:
- Wear;
- Use;
- Laundering;
- Damage;
- Misuse;
- Alteration;
- Modification; or
- Missing packaging, tags, accessories, or components
may be denied.
Any merchandise received that does not meet exchange requirements may be returned to the customer without exchange, credit, or replacement.
The customer shall be responsible for any associated shipping expenses.
Damaged or Defective Merchandise
Customers must notify Bay Area Dancewear within five (5) calendar days of delivery of any alleged shipping damage or manufacturing defect.
Claims must include:
- Clear photographs of the issue;
- A detailed description of the concern; and
- Order number or proof of purchase.
All claims are subject to inspection and verification.
If Bay Area Dancewear determines that a claim is valid, Bay Area Dancewear shall determine the appropriate remedy in its sole discretion, which may include:
- Replacement;
- Exchange for the same item;
- Repair, where available;
- Store credit; or
- Another commercially reasonable remedy.
Normal wear and tear, improper fitting, improper use, accidental damage, abuse, neglect, modifications, misuse, or customer preference issues are not manufacturing defects.
Product Fit and Sizing Disclaimer
Customers are solely responsible for selecting appropriate products, sizing, widths, styles, and fit.
Bay Area Dancewear may provide fitting assistance, recommendations, measurements, and product guidance; however:
- No sizing recommendation constitutes a guarantee;
- Individual comfort and performance vary;
- Manufacturers use different sizing standards; and
- Fit preferences are subjective.
Size, width, comfort, aesthetics, or customer preference do not constitute product defects.
Limitation of Liability
To the fullest extent permitted by law, Bay Area Dancewear's total liability arising from any purchase, product, service, claim, transaction, or dispute shall not exceed the amount actually paid by the customer for the merchandise at issue.
Bay Area Dancewear shall not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, including without limitation loss of profits, loss of use, loss of opportunity, or personal inconvenience.
Nothing in this policy limits any rights that cannot legally be waived under applicable law.
Assumption of Risk
Dancewear, dance shoes, pointe shoes, and related products are used in physically demanding activities that involve inherent risks.
Customers voluntarily assume all risks associated with:
- Product selection;
- Product fitting;
- Product use;
- Maintenance;
- Inspection; and
- Participation in dance and athletic activities.
Bay Area Dancewear is not responsible for injuries, accidents, losses, or damages resulting from improper fit, improper use, misuse, modification, neglect, or normal wear and tear.
California Consumer Rights
Nothing contained in this policy is intended to limit any rights, warranties, remedies, or protections that cannot legally be waived under applicable federal, California, Alameda County, or local laws.
Where applicable law provides a consumer with rights that differ from this policy, those legal rights shall control.
Governing Law
These Terms, Conditions, Returns & Exchanges Policy, and all related transactions shall be governed by and construed in accordance with the laws of the State of California, without regard to conflict of law principles.
Any dispute arising from a purchase or transaction with Bay Area Dancewear shall be subject to the exclusive jurisdiction of the state or federal courts located in Alameda County, California, to the extent permitted by law.
Policy Disclosure
This policy is posted and provided in accordance with applicable California retail disclosure requirements. Customers are encouraged to review this policy before making a purchase. California law requires retailers with limited refund or exchange policies to clearly disclose those policies to customers.
Acknowledgment and Agreement
By purchasing merchandise online, in-store, by telephone, through social media, through a special order, or by any other sales channel offered by Bay Area Dancewear, the customer acknowledges and agrees that:
- They have had the opportunity to review this policy;
- They understand this policy;
- They agree to be bound by this policy; and
- Failure to read this policy does not invalidate or exempt the customer from its application
